1. Eligibility
You must be at least 18 years old and able to form a binding contract under U.S. law to use KoFaso US. By creating an account you represent that the information you provide is accurate, that you are using KoFaso for lawful purposes, and that you are not barred from receiving services under applicable export controls or sanctions.
2. Accounts and security
You are responsible for safeguarding your password and for any activity under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that show signs of fraud, abuse, identity misrepresentation, or repeated policy violations.
3. The marketplace
KoFaso US is a marketplace that hosts the KoFaso Official Store and approved third-party sellers. Except where a listing is sold by KoFaso directly, the seller — not KoFaso — is the legal seller of the item, and is solely responsible for the listing, product quality, accuracy, packaging, and shipment. KoFaso provides the platform, identity verification, payment processing, dispute handling, and buyer protections described in our published policies.
4. Orders, pricing, and payment
- Prices, taxes, and shipping fees are shown at checkout in U.S. dollars.
- Placing an order is an offer to buy; the order is accepted when the seller confirms or ships.
- Payments are processed by our payment partners (including Stripe). You authorize charges for the order total, taxes, shipping, and any agreed adjustments.
- We may cancel orders for pricing errors, suspected fraud, stock issues, or compliance reasons and will refund any amounts already charged.
5. Shipping, delivery, refunds, and returns
Delivery windows are estimates. Risk of loss passes on delivery to the carrier unless local law requires otherwise. Eligible refunds, returns, and meet-up cancellations are governed by our Return Policy and Shipping Policy, which are incorporated into these Terms.
6. Seller obligations
- Provide accurate listings, lawful products, and honest representations.
- Comply with all applicable tax, consumer-protection, intellectual-property, and product-safety laws.
- Ship in the stated handling time and honor approved refunds and returns.
- Maintain payout and identity information; KoFaso may withhold payouts to cover refunds, chargebacks, fees, or suspected fraud.
7. Prohibited conduct
- Fraud, money laundering, identity misrepresentation, or circumventing fees.
- Counterfeit, stolen, recalled, hazardous, or otherwise illegal goods.
- Harassment, hate speech, threats, doxxing, or sexually explicit content involving anyone under 18.
- Reverse engineering, scraping, or interfering with the security or integrity of the service.
- Using KoFaso to send unsolicited commercial messages or to harvest other users' information.
8. User content and license
You retain ownership of the content you post (listings, photos, reviews, messages). You grant KoFaso a worldwide, non-exclusive, royalty-free license to host, display, reproduce, translate, and distribute that content for the purpose of operating, promoting, and improving the service. We may remove content that violates these Terms or our policies.
9. Intellectual property and DMCA
The KoFaso name, logo, software, and design are our property. Rights-holders who believe a listing infringes their intellectual property may submit a DMCA notice to legal@kofaso-us.com; we respond to valid notices and terminate repeat infringers.
10. Disclaimers
The service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free. KoFaso is not the manufacturer of third-party listings and makes no warranty about those items beyond what is provided in writing at checkout.
11. Limitation of liability
To the maximum extent permitted by law, KoFaso, its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from your use of the service. Our aggregate liability for any claim related to the service is limited to the greater of (a) the amounts you paid to KoFaso in the 6 months before the event giving rise to the claim, or (b) USD $100.
12. Indemnification
You agree to indemnify and hold KoFaso harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your content, your use of the service, your violation of these Terms, or your violation of any law or third-party right.
13. Dispute resolution and arbitration
Any dispute between you and KoFaso will first be addressed informally through our Support team. If unresolved, you and KoFaso agree that disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in English, seated in Delaware, USA. Class actions and class arbitrations are waived. Either party may bring an individual claim in small-claims court. You may opt out of this arbitration agreement within 30 days of account creation by emailing legal@kofaso-us.com.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.
15. Termination
You may close your account at any time from account settings. We may suspend or terminate access at any time for violations of these Terms or to protect users, sellers, or the integrity of the service. Sections that by their nature should survive termination (payments owed, IP, disclaimers, liability limits, arbitration) will survive.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email at least 7 days before they take effect. Continued use of KoFaso after the effective date means you accept the updated Terms.
